RENTAL AND PURCHASE AGREEMENT

 

These terms and conditions are a legal agreement between you ("You" or "Your") and My Garde Robe Cyprus at its address 11 Ayias Elenis Street, 1061 - Nicosia, Cyprus ("My Garde Robe Cyprus" "We,", “we” "us," or "our"), establishing terms and conditions under which You will submit information to, and rent and/or purchase clothing and accessories (each a “Product” and collectively, "Products or Items") and receive related services (“Services”) from, My Garde Robe Cyprus via our website at  http://www.mygarderobecyprus.com/ (the "Website").

OUR STANDARD TERMS AND CONDITIONS SET OUT HEREIN SHALL APPLY TO BOTH RENTALS AND/OR PURCHASES MADE VIA OUR WEBSITE AND ALSO MADE IN OUR STORE FOLLOWING INSPECTION OF THE PRODUCTS. 

 

BEFORE YOU PLACE YOUR ORDER AND CLICK ON THE "SUBMIT" BUTTON, CAREFULLY READ THE TERMS AND CONDITIONS OF THIS AGREEMENT. BY ORDERING PRODUCTS OFFERED ON OUR SITE, SIGNING UP FOR THE SERVICE AND PUTTING IN YOUR CREDIT CARD DETAILS, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT. YOU AGREE THAT YOUR GENERAL USE OF OUR WEBSITE, OTHER THAN RENTAL AND/OR PURCHASE ORDERS AS SET FORTH IN THIS AGREEMENT, IS SUBJECT IN ALL RESPECTS TO OUR WEBSITE TERMS OF USE AND PRIVACY POLICY, AS SUCH TERMS MAY CHANGE FROM TIME TO TIME. NO OTHER TERMS OR CONDITIONS (PREPRINTED OR OTHERWISE) SHALL HAVE ANY FORCE OR EFFECT. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, PLEASE DO NOT ORDER ANY PRODUCTS AND DO NOT RENT OR PURCHASE THE PRODUCTS.

 

WE RESERVE THE RIGHT TO CHANGE THE TERMS OF THIS AGREEMENT IN THE FUTURE AND ANY CHANGES WILL APPLY TO THE RENTAL OF ANY PRODUCTS AFTER THE DATE OF SUCH CHANGE. YOUR USE OF THE WEBSITE WILL BE SUBJECT TO THE MOST CURRENT VERSION OF THIS AGREEMENT, RULES AND GUIDELINES POSTED ON THE WEBSITE AT THE TIME OF SUCH USE. YOU SHOULD PERIODICALLY CHECK THIS AGREEMENT TO VIEW THE CURRENT TERMS. IF YOU BREACH ANY OF THE TERMS OF THIS AGREEMENT, YOUR AUTHORIZATION TO USE THIS WEBSITE AND OUR SERVICES AUTOMATICALLY TERMINATES.

 

IN CASE OF A RENTAL YOU AGREE AND ACKNOWLEDGE THAT YOU ARE RENTING THE PRODUCTS AND THAT OWNERSHIP OF THE PRODUCTS REMAINS WITH THE MY GARDE ROBE CYPRUS AT ALL TIMES.

 

1. ADULT AGREEMENT REQUIRED.

 

Our Products may be rented and or purchased only to adults and by renting and/or purchasing our Products you agreeing in and fully accept these Terms and Conditions and You confirm that you are above the age of eighteen (18) years old.

 

2. BECOMING A MEMBER AND OBTAINING AN ACCOUNT 

 

Before you can begin use of the Services, you must register as a member through the Website and be recorded to our clientele database. The Products can only be delivered to registered members (referred to as "members"). The membership subscription will be only for recording purposes and the members can use the Website and rent and/or purchase Products from My Garde Robe Cyprus in accordance with these terms and conditions. You agree to provide true, accurate, current and complete information about yourself as prompted by the Website's registration form (such information referred to as the "Registration Data"), and you agree to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you move or your contact information changes, please inform customer service immediately. At all times, you must provide contact information with which we can reach you via telephone and email. We may contact you from time to time in order to evaluate our service and to ensure your optimal utilization of the Services. 

 

3. PAYMENT 

 

All the payments must be done either in cash or through Credit Card. You must have an Internet access to use our service or visit our shop. In case you use our Products via our Website you may use the following link to arrange your payment. 

 

4. BILLING 

 

If we do not receive payment from your credit card provider or if your credit card expires or is rejected, you agree to pay all amounts due upon demand. In the event of non-payment, we may require you to provide a second valid credit card before continuing to use the Services. You authorize us to charge outstanding fees and other amounts due us against any credit card you have on file with us. We reserve the right to take all steps necessary to collect amounts due from you, including but not limited to legal action and/or using third party collection agencies. 

 

5. DELIVERY 

 

(a) Delivery time for a Product a member selects to rent and/or purchase  may vary based upon the member’s delivery address, the time when a member places an order, the number of items the member already has in their possession, prioritization, and other factors related to the delivery. As such, My Garde Robe Cyprus is unable to make any guarantees as to delivery times. We reserve the right to process orders and otherwise deliver to our members in accordance with our delivery and mailing schedules; 

 

(b)  In the event that an unsecure address is provided, My Garde Robe Cyprus does not bear liability for Products left unattended. Furthermore, You acknowledge that providing anything other than a secure address may result in delivery delays and additional delivery fees for which My Garde Robe Cyprus is not to be held liable, but You will be held liable.

 

6. RISK – INSPECTION FOR DAMAGES ON THE PRODUCTS 

 

The risk of damage for Products passes to the member upon the delivery of the Product(s) to the member at his or her address. The Member should inspect the Products for any defects and/or damages and report these to My Garde Robe Cyprus within 30 minutes upon the receipt of the Product(s).  If the Member does not report any defects and/or damages within the aforementioned time period he/she will be deemed responsible and should remedy My Garde Robe Cyprus depending on the extend of the defects and or damages occurred on the Product(s).  

 

We reserve the right to require the return of any or all rent Products in the member's possession in the event the member fails to make required payments on time or in the event other factors arise which, in our sole discretion, increase the risk of non-timely payment by the member. 

 

7. USE OF THE PRODUCTS 

 

(a) You agree to treat the Products with great care, and return the Products in the same condition as they were delivered to You. You are completely responsible for loss, destruction or damage to the Products due to theft, disappearance, fire, stains or any other cause, other than normal wear and tear. Normal wear and tear encompasses minor stains, stuck zippers or other minor damage covered by the rental fees You paid. If You return a Product that is damaged beyond normal wear and tear, then You agree that we shall charge You, and You shall pay, the retail price of the Product;

 

(b) Sub – rentals are strictly prohibited. 

 

8. RENTAL and PURCHASE FEES 

 

The rental and purchase fee (“Fee”) for the Products will be the rental and purchase fee (as defined on the website or sometimes defined by any discounts offered to you) PLUS any courier charges. 

Upon Your order, You hereby authorize us to charge Your credit card for the Fee. We will charge Your credit card the amount of the Fee immediately upon Your rental order or checkout where you confirm and submit – “Rent Now” or “Purchase Now”.

 

Fees exclude delivery fees, all of which shall be paid by You directly or, if I any case paid by My Garde Robe Cyprus, these shall be reimbursed by You to My Garde Robe Cyprus in connection with Your order for the rental and/or the purchase.

 

9. RETURN OF THE PRODUCTS

 

(a) In case of a rental You shall return the Product(s) to My Garde Robe Cyprus store at its address 11 Ayias Elenis Street, 1061 - Nicosia, Cyprus, the latest by 14:00 o clock of the next day of expiration of rental. In the event where the Product(s) will not be returned by You at the said time above, then, You will be liable for any penalties fees of EURO 15.00 per every delay hour;

 

(b)  With delivery of the Product, we will provide You with a hanger and cover to return the rented Product to My Garde Robe Cyprus. (“Return Packaging”). If the Return Packaging is not returned then My Garde Robe Cyprus will charge you of the Amount of EURO 10.00. 

 

10. CONDITION – APPEARANCE OF THE PRODUCTS

 

(a) Appearance of the Product(s) as these are displayed in the Website. You agree that upon Delivery the Products will appear as decided by You based on Your submitted styles preferences and sizes. You agree that sometimes My Garde Robe Cyprus Products may appear slightly different in color and style than the photos displayed on our website;

 

(b) CleaningAll Products will be professionally cleaned and delivered ready to wear for each consumer. We tumble wash and / or dry clean and inspect each Product with the utmost care, but use of the Product is at your own risk and My Garde Robe Cyprus shall not be held liable for any health-related complaints associated with a product rented from our site.

 

11. NO REFUNDS

 

(a) If an item or multiple items are not to Your taste, We cannot offer a refund. When You agree for our service, You agree that each Product(s) will appear based on Your submitted styles preferences and sizes in our Website. Refunds will only be issued for items that are defective and for which My Garde Robe Cyprus shall bear the risk in accordance with clause 6 above. For the avoidance of doubt and defect on Product(s) which have been inspected, shall be deemed to have been occurred by You and hence no Refund shall be available;

 

(b) Refunds will not be given for styles that do not meet individual taste. If a Product(s) arrives that is too small or too big, but we have sent it based on the sizes You selected, we cannot offer an exchange or refund. Every brands’ sizing chart varies and We cannot be held responsible for such variations. If a mistake is made based on not following a size selected in Your profile, We will make an exchange.

 

12. MARKETING MATERIAL 

 

We will use the preferences and orders You provide on our Website to send You e-mails and other marketing materials for other Products. You may opt out of receiving those e-mails by clicking on the links provided at the bottom of those e-mails when available.

 

13. LIMITATION OF LIABILITY.

 

(a) No Indirect Damages - In no event shall My Garde Robe Cyprus (or its suppliers or licensors) be liable to you or any third party for special, incidental, consequential, exemplary, punitive, multiple or other indirect damages, or for loss of profits or loss of use damages, arising out of the products or services related thereto, whether based upon warranty, contract, tort, strict liability or otherwise, even if the My Garde Robe Cyprus has been advised of the possibility of such damages or losses. 

 

(b) Limited Direct Damages - My Garde Robe Cyprus (and its suppliers’ and licensors’) aggregate liability arising out of products and services related thereto, whether based upon warranty, contract, tort, strict liability or otherwise, shall not exceed the applicable rental fees paid by you for the applicable product and/or service.

 

(c) Use of Results at your risk - You assume sole and exclusive responsibility and liability for any claims against you and/or damages arising from use of the products during your rental period.

 

14. APPLICABLE LAW

 

The governing law of present Agreement shall be the Law of Cyprus and any disputes arising from the present agreement shall be resolved by the Courts of Cyprus.
